Terms & Conditions
1. Who we are
Tacit (tacit.rent) is a software service operated by D. Lerina, an individual ("we", "us"). You can contact us at hello@tacit.software.
2. Our reseller
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
3. The service
Tacit evaluates the facts you declare about your household and income against the rules that apply to eight segments of the Dutch rental market, and issues a verdict: a yes or no outcome per segment, with the rule each outcome is based on. The verdict is delivered digitally, as soon as the evaluation is complete, as three sealed documents: your Declaration, your Positioning and a Narrative. The documents are valid for 90 days from the date they are issued.
4. Your declaration
You are responsible for the accuracy of the information you provide. Tacit does not verify your information against documents or public registers. The verdict reflects only the facts you declared. You may only submit information about yourself and members of your household who have agreed to it.
5. No advice and no guarantee
A verdict is not legal, financial or housing advice. It does not guarantee that any landlord, housing corporation or agency will offer you a home, as they may apply their own selection criteria within the law. A verdict applies the rules in force on the date it is issued; later changes in the law or in your situation may change the outcome.
6. Price and payment
The price is shown on our website and includes VAT where applicable. Payment is processed by Paddle.com. Paddle's buyer terms apply to your purchase.
7. Refunds
Before paying, you expressly agree that your documents are delivered immediately and acknowledge that you lose your statutory right of withdrawal once they are delivered. We confirm this by email. Delivered documents are refunded only in the cases described in our Refund Policy.
8. Acceptable use
You may not use Tacit to create verdicts for people without their consent, submit information you know to be false, access the service by automated means, or resell verdicts or the service.
9. Intellectual property
The Tacit software, rules engine and website remain our property. Your verdict is yours to use and share for your own housing search.
10. Liability
To the extent permitted by law, our total liability for any claim relating to a verdict is limited to the amount you paid for it. Nothing in these terms limits rights you have under mandatory consumer law.
11. Changes
We may update these terms. The version in force when you purchase a verdict applies to that purchase.
12. Governing law
These terms are governed by Dutch law. If you are a consumer, you keep the protection of the mandatory laws of the country where you live.
